☁️ 1. ZERO-HOSTING & LINK-BASED HOSTING PHILOSOPHY

Omnipins operates on a Link-based Hosting architecture (external storage, internal orchestration) and positions itself as an Orchestrator of Value.

• Declaration of Non-Ownership of Source Data: The Omnipins system completely does not own, copy, hold, or store any physical original files (including images, audio, video, music, design documents, or articles) of Creators on our internal servers.
• BYOS Model (Bring Your Own Storage): All Completed Artifacts of Creators are stored independently on their own personal cloud accounts (such as Google Drive, OneDrive, Dropbox, S3, R2).
• Liability Commitment: Responsibility for management, security permissioning, file integrity, and copyright rests entirely with the individual Creator owning that cloud account. Omnipins is completely exempt from any joint liability arising from Creators' file management practices.

🛡️ 2. COPYRIGHT JOINT LIABILITY WAIVER (SAFE HARBOR)

Because we do not control or store original files on our servers, Omnipins establishes a robust legal barrier under the Digital Millennium Copyright Act (DMCA):

• Copyright Belongs to the Creator: When pasting links onto Omnipins, Creators bear 100% legal responsibility before the law regarding intellectual property, copyright, and commercial distribution rights for their works.
• No Indemnification Liability: Omnipins does not represent, warrant, or assume any civil or criminal liability if Creators post links containing pirated content or infringe upon third-party intellectual property.
• DMCA Takedown Mechanism: Upon receiving a valid infringement notice from actual copyright owners via the Copyright & DMCA Portal, Omnipins will immediately execute a temporary display lock (Flagged Content) within 24 hours for review, without any legal liability for revenue losses incurred by the reported Creator.

⚡ 3. LINK DECAY & EXTERNAL LINK VALIDATION

As the system relies entirely on third-party cloud storage infrastructures (Google, Microsoft, Dropbox...) and Creators' personal settings, the risk of Link Decay is entirely possible.

• Link Decay Risks: Creators may accidentally delete files, exceed cloud storage quotas, forget to renew storage plans, or change sharing permissions from "Public" to "Restricted". Consequently, buyers may encounter 404 errors or fail to download original files.
• External Link Validator API: To maximize user protection, Omnipins integrates a background patrolling API. The system automatically pings to check link health and public sharing status right before transactions occur. If a broken link is detected, the checkout button automatically locks.
• Guarantee Limitations: Despite cross-checking APIs, Omnipins cannot guarantee 100% continuous uptime for these external links. Buyers accept this risk and must independently verify before proceeding with transactions.

⚖️ 4. NO-REFUND POLICY

Omnipins enforces a strict financial policy to safeguard the integrity of the creative economy:

• Direct Download Purchases: Due to the intangible and instantly replicable nature of digital assets upon downloading, all direct artwork purchases are strictly non-refundable under any circumstances once the system successfully issues a temporary Download Session Token (encrypted download token).
• Memberships (Subscriptions): Subscription fees for Pro, Premium, or GOLD tiers are non-refundable once activated. Users retain the right to cancel renewals anytime to stop future cycle charges.

🔒 5. CLOUD CONNECTION SECURITY & FILE TRANSMISSION (AES-256)

We always place your information security and privacy as our top priority:

• Strict Context Isolation: All API keys and tokens connecting your Google Drive, OneDrive, or Dropbox accounts are automatically encrypted using AES-256-CBC algorithms before database persistence. Omnipins and the admin team can never access or misuse your tokens outside of serving you in the Frontend Studio.
• Download Session Token: When buyers download files, the system uses a stream transmission mechanism via intermediate files, completely concealing Creators' original folder structures to prevent link leaks or folder scanning.

⚡ 6. MOCK MODE & SIMULATED DATA

All data displayed or transaction actions occurring in Mock Mode (testing via virtual VietQR or Lemon Squeezy Sandbox) are simulated parameters for technical testing. They do not represent any real-world cash flow or legal obligations towards Omnipins or affiliated banks.
