DMCA & COPYRIGHT POLICY

Welcome to Omnipins. We strictly respect the intellectual property rights of artists and content creators and expect our users to do the same.

This DMCA & Copyright Policy document details how Omnipins receives, handles, and resolves claims regarding digital copyright infringement pursuant to the US Digital Millennium Copyright Act (DMCA) and global copyright protection standards.


☁️ 1. ZERO-HOSTING MODEL AND SAFE HARBOR EXEMPTION

1.1 Link-based Hosting Architecture (BYOS)

Omnipins does not operate as a data repository or physical file storage library. We operate on a Link-based Hosting model (external storage, internal orchestration) under the role of Orchestrator of Value.

All high-quality original files (images, audio, video, art documents) of Creators are stored completely independently on their own personal cloud accounts (BYOS - Bring Your Own Storage such as Google Drive, OneDrive, Dropbox, AWS S3, Cloudflare R2).

The Omnipins system completely does not own, copy, house, or store any physical original files of Creators on internal server systems.

1.2 Creator's Sole Legal Liability

Since Omnipins retains no physical control over source files:

  • Creators are solely and 100% legally responsible for the legality, copyright, intellectual property rights, and commercial distribution rights of links they post onto the system.
  • By pasting links onto Omnipins, Creators commit that their works do not infringe upon the intellectual property rights of any third party.

1.3 Joint Liability Exemption

Omnipins is completely exempt from any civil, criminal liability or damage compensation obligations arising from external links posted by Creators containing copyright-infringing content or violating third-party intellectual property. We establish a robust legal barrier strictly complying with Safe Harbor provisions for intermediary data transmission service providers under the DMCA.

🛡️ 2. DMCA TAKEDOWN NOTICE PROCEDURE

If you are a rightful copyright owner or an authorized legal representative, and you believe any link or content displayed on Omnipins infringes your intellectual property rights, you have the right to submit an official DMCA Takedown Notice to our Copyright Department via email: copyright@omnipins.com.

For the notice to be legally effective, it must contain all of the following written elements:

  • Your Identification Info: Full name, mailing address, phone number, and official email address for response contact.
  • Identification of Infringed Original Work: Detailed description and legal proof verifying legal ownership of the original work claimed to be infringed (e.g., link to original work, copyright certificate, or prior publication proof).
  • Identification of Infringing Link on Omnipins: Exact URL displayed on Omnipins pointing to the page containing the link you request to remove or lock from display.
  • Good Faith Statement: A statement that you have "a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  • Accuracy Statement & Legal Commitment: A statement that "the information in this notification is accurate, and under penalty of perjury, you are the copyright owner or authorized to act on behalf of the owner."
  • Electronic or Physical Signature: Valid physical or electronic signature of the copyright owner or authorized representative.

Note: Under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for full damages and legal fees incurred by the reported party or Omnipins.

⚡ 3. ACTION PROTOCOL

Upon receiving a complete and valid DMCA notice meeting legal criteria in Section 2, Omnipins commits to executing an emergency action protocol within 24 hours of receipt:

3.1 Temporary Display Lock (Flagged Content)

The system automatically transitions the status of the disputed work to Flagged Content across the entire Frontend user interface. Download links and multimedia players for that work are instantly disabled to prevent further downloading or dissemination. All data is logged into wp_zen_copyright_reports for admin audit and reconciliation.

3.2 Creator Notification & Auto-Correction

The system automatically dispatches email and In-App notifications to the reported Creator, clarifying reasons for Flagged status and providing complainant contact info for mutual resolution. If errors stem from mistakes or cloud link misconfigurations, Creators have 7 days to self-correct or paste new legal links.

3.3 Escrow Protection

To protect buyers' financial interests for paid Marketplace items, Omnipins operates a 7-day Escrow holding mechanism. If works are locked due to valid DMCA notices arising within 7 days of transaction, the system automatically refunds 100% of transaction funds to buyers from escrow and revokes download rights without manual intervention.

⚖️ 4. COUNTER-NOTIFICATION POLICY

If a reported Creator believes their work was flagged or locked due to mistake, misidentification, or a fraudulent DMCA notice, they may submit an official Counter-Notification to our legal support email: copyright@omnipins.com.

A valid counter-notice must contain in writing:

  • Creator Identification: Full name, contact address, phone number, and email.
  • Identification of Locked Work: Exact title and original URL on Omnipins prior to lock.
  • Legal Commitment Statement: Statement under penalty of perjury that "I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification."
  • Jurisdiction Acceptance: Statement consenting to Federal District Court jurisdiction where the Creator resides (or Omnipins server/office location if outside the US) and accepting service of process from the original complainant.
  • Signature: Valid physical or electronic signature.

Post-Counter Processing: Omnipins forwards the counter-notice to the original complainant. Under DMCA rules, the complainant has 10 business days to provide court lawsuit evidence against the Creator. If no court evidence is provided after 10 business days, Omnipins automatically restores normal public operation status to the work within 10 to 14 business days.

🚫 5. REPEAT INFRINGER POLICY

To ensure integrity across the global creative environment, Omnipins applies a strict Three-Strike Policy for repeated copyright infringers:

  • First Infringement: Official warning email; work permanently flagged or required to fix legal links.
  • Second Infringement: Temporary block on posting new works outside Frontend Studio for 30 days, plus downgrading Global Discovery Feed privileges to standard.
  • Third Infringement: Permanent account freeze, secure disconnection from personal Cloud accounts (BYOS), forfeiture of Certified Creator Badges, cancellation of PRO/PREMIUM/GOLD memberships, and permanent domain/IP ban.

Omnipins reserves absolute rights to terminate or suspend any user violating community standards or copyright policies anytime without prior notice and without fee refund obligations.
