⛩️ ARTICLE 1: LEGAL DEFINITION & SERVICE NATURE ("VALUE PIPELINE")

1.1 Orchestrator of Value

Omnipins is not a traditional "publisher", "digital archive", "hosting social network", or "hosting provider". Omnipins positions itself as an Orchestrator of Value — providing intermediate technical infrastructure, the ZDA (Zen Discovery Algorithm) smart recommendation engine, and automated payment routing systems to orchestrate creative value from the artist's cloud to the appreciator's living space.

1.2 Zero-Storage / Link-based Hosting Architecture

Omnipins operates on the principles of Zero-Cost Infrastructure and Zero Source-File Storage. The platform absolutely does not house, back up, or retain any physical files (original images, high-definition videos, original WAV/MP3 audio files) belonging to creators on our server systems.

1.3 Value Pipeline

The system acts strictly as a "value pipeline". We assist artists in directly connecting their personal cloud storage spaces (BYOS - Bring Your Own Storage such as Google Drive, OneDrive, Dropbox, Cloudflare R2) to transmit secure download links (Encrypted Token Hand-off) to buyers upon successful transactions.

🛡️ ARTICLE 2: SOURCE FILE ZERO-STORAGE DISCLAIMER

2.1 Creator's Sole Liability

Since Omnipins does not store source files, Creators sharing links on the platform bear 100% civil and international criminal legal responsibility regarding the content, copyright, legality, and commercial distribution rights of those files.

2.2 Exemption from Joint Liability

In all cases of disputes, claims, or litigation related to trademark violations, copyright infringement, or illegal content shared via external links by Creators, Omnipins and its administration are completely exempt from joint liability.

2.3 Trust Bridge & Link Decay

The system runs an automated External Link Validator API tool. This tool periodically pings to check whether the artist's cloud link exists and remains publicly accessible before transactions occur. However, Omnipins assumes no responsibility for Link Decay arising from the user side (e.g., artists accidentally changing privacy settings, deleting files on personal Cloud, or suspended accounts by Google/Microsoft).

2.4 DMCA Policy / Safe Harbor

To comply with the Digital Millennium Copyright Act (DMCA) and establish a safety shield for the system, Omnipins commits to executing a temporary display lock (Flagged Content) within 24 hours for any link receiving a valid copyright infringement report from actual rights owners via copyright@omnipins.com.

💎 ARTICLE 3: PAYMENT ROUTING & STRICT NO-REFUND POLICY

3.1 Contextual Currency Isolation

The system automatically detects users' geographic locations (Geo-IP) to separate currency flows: Vietnam Market (VND) utilizes domestic gateways (PayOS Dynamic QR, SePay Auto Bank), and International Market (USD) utilizes Lemon Squeezy as Merchant of Record (MoR).

3.2 Strict No-Refund Policy

To protect artists' economic interests and the easily replicable nature of digital assets, Omnipins enforces an ABSOLUTE NO-REFUND POLICY once services or download privileges are activated:

• Direct Download Purchases: Completed immediately upon payment confirmation and temporary Download Session Token issuance; buyers are strictly prohibited from requesting refunds under any circumstances.
• Subscriptions: Monthly or annual Pro/Premium subscription fees are non-refundable once activated. Users may cancel renewals anytime; past privileges remain active until the current cycle ends and automatically downgrade to Free next cycle.

3.3 Royalty Engine

Upon direct retail purchase transactions, revenue splits automatically at checkout (Smart Checkout): Artists receive 60%, 80% to 90% (depending on Creator's PRO, PREMIUM, or GOLD tiers at the time of sale) and Omnipins collects a maintenance commission ranging from 10% to 40%.

🚫 ARTICLE 4: CONTENT & USAGE POLICY

4.1 Strictly Prohibited Content

Users are strictly prohibited from sharing links leading to: pornography, CSAM; violence, terrorism, racism, religious hatred; instructions for weapons, explosives, narcotics, or self-harm; malicious software, malware, or spam files.

4.2 Violations Handling & 4.3 Account Sharing Audit

Violating accounts face immediate permanent suspension, forfeiture of revenue balances, and IP blocking. Automated IP audits run periodically; accounts detected interacting across more than 5 distinct IPs simultaneously will face temporary download restrictions for verification.

⚖️ ARTICLE 5: GOVERNING LAW & DISPUTE RESOLUTION

5.1 Governing Law & 5.2 Dispute Resolution

This agreement is governed by the laws of Vietnam for domestic transactions, and international e-commerce commercial laws for Lemon Squeezy transactions outside Vietnam. Disputes are first resolved through amicable mediation before escalating to competent courts.

✨ Final Acknowledgement: By using Omnipins, you acknowledge understanding of the zero-storage mechanism, agree to the No-Refund policy, and commit sole ultimate liability for all shared link contents.
